1.1. It is understood that Photography by Inspiring Action Media LTD (“Photographer”) is the exclusive, official photographer retained to perform photographic services requested on this contract.

1.2. Photographer reserves the right to use negatives, RAW images, edited images and/or reproductions for advertising, display, publication or other purposes, not restricted to use on the web, Facebook, business cards, or posters.

1.3. No part of any order, including previews, will be delivered until the balance is paid in full. Payment for prints is required in full at the time of placing an order. Prints will not be ordered until payment is made.

1.4. Original photographs are included at the discretion of the photographer. Photographer retains the right to edit the photographs. it is understood that Photographer will not deliver every exposure taken. By accepting these Terms and Conditions, the client agrees to abide by Photographer’s editing decisions.

1.5. The photos will be delivered via a Dropbox link sent to an email of the client’s choosing.

Dropbox are to be used photos for printing and may be used on the web, Facebook, or email. The Dropbox images will be available for 10 days after they have been sent to the client.

By accepting these Terms and Conditions, the client understands that when publishing photos on websites, i.e. personal website and all social media platforms, the client will not edit the photos in any way, i.e. editing the watermark, cropping, filters, and any other alteration of the image as provided by the Photographer.

1.6. The Photographer will accept no liability for the loss of the photos after delivery, thus the client is responsible for making a backup of all photos from the Dropbox link. The Photographer will make every attempt to keep archival copies of photos but does not guarantee that they will be retained indefinitely.

1.7. The client confirms that the selections made on the website are accurate. The Photographer shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation. Client will be respectful to Photographer and all parties being photographed. Photographer has the right to end the session.

1.8. The charges in this contract are based on website selections made by the client. This price list is adjusted periodically, and future orders shall be charged at the prices in effect at the time the order is placed.

1.9. In the event Photographer institutes an action to enforce any term or condition herein, the cost of such action will be at the expense of the client. The terms and conditions herein shall be governed by the laws of England.

1.10. Client shall receive photos within 5 days of the chosen date. The Photographer will provide a deadline within which the client must provide the products to be photographed. Receipt of the images will rest solely on the client meeting the deadline. A missed deadline will result in the client rebooking at their own cost. If the deadline is missed the client must show a receipt of when the post was sent. The photographer will agree to provide a refund if the post was delivered at least a week before the deadline for national deliveries and two weeks for international.

1.11. The client must select that they want their merchandise returned via the content farm website and have to provide a return label and address for merchandise to be returned. The photographer is not responsible for any loss or damage.

1.12. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs without the Photographer’s permission, and violators of Law will be subject to its civil and criminal penalties.

Photographer retains copyright to the photographs. Printing and/or distribution rights granted as noted below.

1.13. This Contract incorporates the entire understanding of the parties. Modification to this Contract must be in writing and signed by both parties.

1.14 If a model selected by a client for an order is not available for any reason the photographer will find use an alternative to fulfil the order.

1.15 If the photographer cannot shoot on the date chosen by the client due to reasons out of their control for example bad weather, Covid, roadworks, force majeure, then another shoot shall be organised as a replacement. If a different time cannot be organised within a month of the original shoot date the client may receive a refund.

1.16 Video clips will be sent via dropbox to the client as requested in the order.

1.17 Clients that request for editing will get a simple edit with clips transitioning between one clip to another with some colour retouching.

1.18 The photographer will decide on the quality of the photos or videos taken for the client and it will be at their sole discretion if a partial or full refund is to be given to the client on request.

1.19 The photographer owns the full rights to all content. Clients liscence the material they purchase for up to two years from the date of purchase and can use the content on social media, email marketing and websites.
